The following Terms and Conditions ("Terms") outline your obligations when utilizing the services offered by Editly LLC ("Editly", "The Company", "we", "us", or "our"), a registered limited liability company in Delaware. By accessing or employing the services furnished by Editly, you consent to adhere to these Terms.
The terminology "copy-editor," "proofreader," "editor," or "editors" signifies our collaborator(s) who provide editorial services to you via our website. The terms "content," "document," "text," or "job" indicate any written content you submit to Editly for editing. "Work" refers to your text post editing by a copy-editor. "Copy-editing," "proofreading," or "editing" designates the tasks performed by our editors.
SERVICES:
Editly is an on-demand platform offering expert human copy-editing and proofreading. Our priority is to set clear expectations for you and our copy-editors.
When you submit content to Editly, an immediate price estimate is presented. This estimate encompasses grammar, spelling, punctuation, consistency, and textual structure review and corrections. All estimates are non-obligatory.
Our copy-editors adhere to a uniform set of guidelines that elaborately illustrate the editing process for all documents.
PAYMENT:
Upon placing an order with Editly or purchasing Editly Credit, the payment is moved to a secure bank account. Any service ordered will default to Editly Credit for payment, provided that the amount of Editly Credit in the user or organizational account is sufficient.
EDITLY CREDIT:
Editly Credit is for use only on editly.ai and is tied to an individual user or organizational account. It cannot be transferred between Editly user or organizational accounts, within Editly, or anywhere outside of it, and it cannot be exchanged for any other cash equivalent.
COPY-EDITING:
Copy-editing your text includes reviewing grammar, spelling, punctuation, consistency, and textual structure, and making necessary corrections. Copy-editing does not involve development, rewriting, ghost-writing, or evaluation of the text.
DELIVERY AND DEADLINES:
All provided delivery dates and times are estimates, based on prior orders of the same scale. Editly cannot be held accountable for any loss or damage resulting from a delay beyond the estimated delivery time.
THE COPY-EDITOR’S RIGHT TO REJECT THE JOB:
Upon receiving the text, the copy-editor retains the right to reject the job if it falls short of the standard required for job completion. This extends to situations where the copy-editor realizes that they cannot meet the required standard for any reason. If the copy-editor rejects the job, you will be notified via email, and you will be refunded according to our Refund Policy.
THE CLIENT’S RIGHT TO REJECT THE WORK:
Once the copy-editing is finalized, you have three business days to assess, accept, or claim a re-edit. In case of failure to do so, you are considered to have approved the work.
If you don't approve the work, you can request a re-edit, clearly stating your reasons. When requesting a re-edit, you must not have altered the content and should have addressed all notes and comments from the copy-editor. Failure to provide a reason for your refusal of the edited text is taken as acceptance of the work.
If you request a re-edit, the copy-editor will perform the re-edit at no additional cost to you.
If you reject the re-edited content, and your claim is valid and backed by substantial evidence, you will be refunded according to our Refund Policy, and the copy-editor will not receive any payment.
REFUND POLICY:
Any refund will be issued only in Editly Credit, credited to the individual user or organizational account that originated the editing service.
WITHDRAWAL OF EDITLY CREDITS:
Any withdrawal request should be sent to payment@editly.ai for review. Please note that every account is limited to one (1) withdrawal request every six (6) months. If approved, any bonus credit applied at the time of the credit purchase will be subtracted from the remaining credit amount at the time of the withdrawal request to give the final withdrawal amount.
Editly Credit can only be withdrawn if it was purchased through a verified deposit with an Editly account. No credit given to any account at any time for any promotional purpose is withdrawable for any reason.
CONFIDENTIALITY:
Editly recognizes that copy-editors may be exposed to confidential information in the form of sensitive or unpublished content. To ensure client confidentiality, all Editly copy-editors agree to operate under a non-disclosure agreement by using the service. The non-disclosure agreement can be viewed in full on the "Non-disclosure agreement" page.
Note: Exercise caution when submitting extremely sensitive content to Editly. Editly cannot be held responsible for any form of leak of material by copy-editors.
LIABILITY:
Although we aim to deliver a top-notch service with an exceptional product, we will not be held accountable for any loss or damage, including but not limited to indirect or consequential loss or damage, or any loss or damage whatsoever resulting from loss of data or profits arising from or in connection with the use of this website.
Efforts are made to ensure the smooth operation of the website. However, Editly is not responsible for, and will not be held accountable for, the website being temporarily down due to technical issues beyond our control. It is the clients' responsibility to protect any original material sent to Editly.
While Editly maintains both original and edited documents with every order history, Editly cannot be held liable by the copy-editor or the client for any loss of data on the website. The client is solely accountable for any obscenity, blasphemy, racism, plagiarism, and copyright infringement.
Any content created by Editly as part of the work done by editors will be under the client's copyright.
RE-EDITS AND REFUND POLICY:
Given the human involvement in all editing and proofreading assignments, Editly provides a comprehensive assurance of our work based on a mix of free re-edits and a refund in credit as per our Refund Policy subject to a head editor review:
For each job, you can claim up to three free re-edits by the same editor. All re-edit claims must be made before the job automatically closes after 72 hours. If you're still not satisfied after claiming up to three (3) free re-edits, we will offer you a refund in credit as per our Refund Policy. A refund is contingent upon a review by a head editor. For instance, if the head editor determines that the original editor detected and corrected only 95 percent of the errors in a text, we will offer you a 5 percent refund. All refund claims are processed within 72 hours.
DATA ERASURE GUIDELINES:
The General Data Protection Regulation (GDPR) mandates developers to provide a mechanism for users to request deletion of their data. If you wish to deactivate your account and/or erase your data from Editly, please make a formal request to legal@editly.ai.
INTELLECTUAL PROPERTY:
All content, features, and functionality on the Editly platform, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are the property of Editly, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
GOVERNING LAW:
These Terms and any dispute or claim arising out of or related to them, shall be governed by and interpreted in accordance with the internal laws of the State of Delaware, without giving effect to any choice or conflict of law provision or rule.
MODIFICATIONS TO THE TERMS:
Editly reserves the right to modify these Terms at any time. All changes will take effect immediately upon their posting on the site and by accessing or using the services, you relinquish any right you may have to receive specific notice of such changes.
By using our services, you acknowledge that you have read, comprehended, and agreed to be bound by these Terms.
